Terms of Service
GENERAL
✦ I, the Artist, have the right to decline or discontinue a commission at any time.
✦ Please note that these commissions are a digital service, and do not require any shipping of a physical item.
✦ Terms and conditions are subject to change to protect myself and the commissioner.
✦ The client must read, understand, and agree to all the terms. By continuing with the commission and going forth with the payment, the client has agreed to the terms of service.
✦ The client must provide the artist with clear, VISUAL references so that I may deliver the most accurate service possible. Bullet points in addition to VISUAL references are acceptable, however I do not work off of written descriptions alone at this time.
✦ Refusal to provide references for the commission in a timely manner will result in the client's request being moved to the bottom of the queue or cancelled.PAYMENTS
✦ Payment is expected within 48 hours unless the client has communicated with me and we have come to an agreement.
✦ I, the artist, will not start on a commission until the payment has been completed.
✦ Payment Plans are accepted on a case-by-case basis and are not guaranteed. Please make sure you message me promptly so we may discuss and lay out the Payment Plan for the commission request.
✦ Prices are subject to change according to size, complexity, and/or detail of the piece at the discretion of the artist.REVISIONS
✦ The artist will send a sketch to the commissioner for approval before moving to completion of the work.
✦ Any revisions past the "sketch" phase will incur a revision fee where applicable.
✦ The artist will make edits to the work after completion if I made a mistake with the design. Edits that are due to the customer being unclear may incur a fee.
✦ Revisions are not available for all commission services, and will be stated if they are unavailable. Please make sure to read the service's details to see if revisions apply.DEADLINES AND DELIVERY
✦ If there is a deadline for the artwork, you MUST inform me beforehand so that we may come up with a plan. Depending on the deadline, a rush fee may be applied.
✦ The final commission piece will be sent through VGen, and may also be sent through email provided by the client in order to receive the full quality image.
✦ The time it takes to finish your commission varies depending on the complexity of the artwork, other work and availability.
✦ Allow up to 3 months for commission turnaround, this can depend on commission complexity, workload, and accounts for my physical and mental health flare ups. I strive to be transparent to the client should the expected delivery time change.USE
✦ The final product is strictly for personal use. For commercial use, the rights must be purchased.
✦ If the client posts the commission on their social media, they MUST credit and link back to me.
✦ The client may use the work as an avatar/icon, wallpaper or header or similar decoration as long as credit is given.
✦ The client may NOT edit in any way the original file. Any edits done to the work must be requested and explicitly given by the artist.
✦ Removing any artist signatures/watermarks is a violation of these terms.
✦ The client may print a copy of the commissioned artwork for personal use if provided with written consent by the artist. It may not be redistributed or sold in any way.INTELLECTUAL PROPERTY RIGHTS
✦ I, the artist, hold the rights over my commissions. (e.g. to post on my social media, use for publicity, prints, graphics, merchandise etc.)
✦ The client does not hold the right to use the product in any Generative A.I related technology, including Machine Learning Models or future inventions in the space.
✦ The client does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
✦ The artist does not claim any rights to any intellectual property or the character(s).
✦ The client may not claim the commissioned piece as theirs in any way, shape, or form.
✦ The artist reserves artistic rights over the artwork.REFUNDS
✦ If the client wishes to cancel the commission before payment, there are no repercussions. The commission will be canceled and no further action needs to be taken by the client.
✦ Once I have begun working on the commission, refunds can not be provided.
✦ If the client wishes for a refund after the commission is completed, refunds can not be provided.
✦ I will allow refunds if it has been more than 2 weeks and I have not started on your commission.
✦ In the case I am not able to finish the commission (such as in case of an illness or major life event), I will offer a refund initiated by myself.
✦ Chargebacks are not acceptable, especially if the work has been delivered. If there are any issues, the client MUST communicate with me, and depending on the situation I, the artist, may provide a refund or establish a repayment plan.COMMUNICATION
✦ Inappropriate/aggressive behavior of any kind will not be tolerated. Should this or a breach of the Terms of Service occur, the artist may stop or cancel the commission.
✦ Poor communication may also be grounds for stopping the commission and may also result in being added to my blacklist and banned from requesting my services in the future.
✦ The client may ask for progress/status on their commission. Due to my full-time job outside of art, please allow 48 hours between progress/status requests.
